“Lucky Draw”

1.By entering this Lucky Draw, you are indicating your agreement to be bound by these terms and conditions. You are advised to read carefully the hereunder terms and conditions and if you do not agree to these, please do not participate in the Lucky Draw in any manner.

2.These terms and conditions are subject to the OKTO Consumer Terms and Conditions, OKTO KYC/AML Levels and Limits and the OKTO Privacy Policy set forth on the OKTO Website (www.oktowallet.com).

3. You may opt-out from the Lucky Draw whenever you wish. Please send your request at the following email address: support@oktopay.eu and the relevant customer support agent will process your request and inform you accordingly.

4. The Lucky Draw is offered solely to the new users of the *OKTO App by “OKTOPAY CONNECT LTD” (hereinafter referred to as OKTO), based in Cyprus, Klimentos Str. 25B, Ag. Antonios, P.C. 1061, Nicosia, Cyprus, with registration number HE393206, acting as an electronic money distributor of UAB “PAYRNET”, a company incorporated in the Republic of Lithuania (company number: 305264430) with its head office at AltSpace, Islandijos str. 6, LT-01117, Vilnius, the Republic of Lithuania and its registered office at Girulių str. 20, LT-12123 Vilnius, the Republic of Lithuania and authorized as an Electronic Money Institution supervised by the Bank of Lithuania (license LB001994).

*The OKTO App is offered in Spain through the gaming machines provided by CODERE ESPAÑA S.A.U. For the conduct of this Lucky Draw shall be used the retail network of CODERE ESPAÑA S.A.U.

5. This Lucky Draw is free to enter.

6. No betting participation to any of the gaming services offered by the retail network of CODERE ESPAÑA S.A.U. is set forth as a prerequisite for your participation in the Lucky Draw. More information with regards to eligibility and participation are available hereunder.

7.Eligibility and Participation

The participation in the Lucky Draw is allowed to any individual over 18 years of age that reside in Spain.

This Lucky Draw is open exclusively to the new users of the OKTO App who will add electronic money of at least five EUR (5€) (“top up”) to their OKTO.Wallet for the first time by selecting the available funding source of their preference throughout the duration of the Lucky Draw in accordance with the OKTO Consumer Terms and Conditions.

To participate:

Download the OKTO App;
Complete the registration and verification process for opening a new OKTO Account, in accordance with the OKTO KYC/AML Levels and Limits set forth on the OKTO Website;
Top up your OKTO.Wallet with at least five EUR (5€).

OKTO may disqualify any entrant whose entry does not comply with these terms and conditions (at OKTO’s discretion) or who, in OKTO’s sole determination, has acted in a manner that is fraudulent, dishonest, unjust to other entrants or in breach of these terms and conditions.

8. Duration

Participation it this Lucky Draw is available from Friday 2^nd of December 2022 (00.00h UTC +1) (“Start Date”) until Sunday 18^th of December 2022 (17.00 UTC +1) (“Closing Date & Time”). Entries received outside of this time period will not be considered.

9. Restrictions

Users are permitted to hold only one (1) OKTO Account.

OKTO reserves the right, at its sole discretion, to decline registration of any participation in the Lucky Draw and/or disqualify any participant in the Lucky Draw in case of tampering or attempt to tamper with the operation of the Lucky Draw (“Lucky Draw Abuse”).

Specifically, a Lucky Draw Abuse includes, but is not limited to:

a. breach of these Lucky Draw terms and conditions and/or any of the OKTO Consumer Terms and Conditions set forth on the OKTO Website;

b. the opening of multiple accounts with the purpose of having more entries in the Lucky Draw;

Where there is a reasonable suspicion that the User has committed or attempted to commit a Lucky Draw Abuse, either on their own or as part of a group, OKTO reserves the right to (cumulatively or selectively):

a. revoke, deny, or withdraw the User’s participation from the Lucky Draw;

b. exclude the User from any future promotional offer;

c. terminate the User’s OKTO Account with immediate effect, according to the provisions of the OKTO Consumer Terms and Conditions.

10. Winners & Prizes

Three (3) winners will be chosen from a random draw of the eligible entries received in accordance with these terms and conditions. The draw will take place at the Codere Venue (Carrer del Coral, 07400 Alcúdia, Illes Balears) on the 18^th of December 2022.

The first designated winner will receive a one hundred EUR (100€) Amazon eGift Card and the two following designated winners will receive each a fifty EUR (50€) Amazon eGift Card.

The prizes are non-exchangeable, non-transferable and are not redeemable for cash or other prizes. OKTO will not take responsibility for any lost gift cards – replacements cannot be issued.

OKTO reserves the right to substitute the prize with another prize of equal or higher value if circumstances beyond OKTO’s control make it necessary to do so.

The decision of OKTO regarding any aspect of the Lucky Draw is final and binding, and no correspondence will be entered into about it.

OKTO makes no representation or warranty in relation to the prize provided and, to the fullest extent permitted by law, OKTO shall have no liability in relation to the prize, its fitness for purpose, merchantability or otherwise.

Winner announcement

The designated winners will be notified within 28 days after the Closing Date.

OKTO may request the winners to participate in any publicity or promotion organized by OKTO in the OKTO social media (facebook, Instagram, Linkedin & twitter), including promotional photographs. The winner may choose to participate in the said publicity or promotion organized by OKTO at his/her own discretion.

Receipt of the prize

Please allow 14 days for delivery of the prize or alternative collection or delivery arrangements may be made through mutual agreement.

Limitation of Liability

OKTO accepts no responsibility for any damage, loss, liabilities, injury or disappointment (including without limitation any loss of profits, loss of revenue, loss of goodwill) incurred or suffered by any entrant that arises out of or in connection with the Lucky Draw or as a result of either participating in the Lucky Draw, winning the Lucky Draw or using the prize, save that OKTO does not exclude its liability for death or personal injury as a result of its own negligence.

If an act, omission, event or circumstance occurs which is beyond the reasonable control of OKTO and which prevent OKTO from complying with these terms and conditions, OKTO will not be liable for any failure to perform or delay in performing its obligations.

OKTO shall not be liable for any failure by any third party to allow you to redeem your prize or for any misrepresentation or other damage caused by any third party arising out of or in connection with the redemption or use of your prize.

Data Protection

Participant’s personal data may be collected, stored, processed and transferred to CODERE ESPAÑA S.A.U. by OKTO for the purposes of administering the Lucky Draw OKTO will comply will all requirements of the General Data Protection Regulation (Regulation 2016/679) and any other applicable personal data legislation.

OKTO shall use any personal information the entrants supply by entering this Lucky Draw as described in the OKTO Privacy Policy which can be found on OKTO Website.

By entering the Lucky Draw, you agree to the collection, retention, and usage of your personal information in order to process and contact you about your Lucky Draw entry.
If you provided consent on the registration page, your personal data will also be used for marketing activities.

General

OKTO reserves the right to cancel, withdraw, terminate, or temporarily suspend this Lucky Draw or amend these terms and conditions at any time, in case of unavoidable circumstances beyond OKTO’s control that make it necessary and to the extent this would not be unfair or will not disadvantage those who sought to participate within the original terms. The entrants may be notified via e-mail.

In the above cases, OKTO bears no responsibility towards the entrants and the entrants are not able to request the completion or continuation of the Lucky Draw and/or to claim damages.

If any of the above cases occur, any participant that wishes to withdraw its participation in the Lucky Draw shall sent an e-mail to support@oktopay.eu, stating explicitly that it wishes to withdraw its participation. If the users do not withdraw their participation by following the above procedure, their participation in the Lucky Draw will be considered valid, and it will imply that they tacitly and unconditionally accept the terms and conditions of the Lucky Draw, as these are amended.

If any of these clauses should be determined to be illegal, invalid, or otherwise unenforceable then it shall be severed and deleted from these terms and conditions and the remaining clauses shall survive and remain in full force and effect.

The Lucky Draw and these terms and conditions shall be governed by and construed with the laws of Spain and any disputes will be subject to the exclusive jurisdiction of the Courts of Spain.
